Better World (“We” or “Our”) is a company incorporated under the laws of France with a share capital of 50.000 € whose registered office is at 25, Rue Ernest Cognacq, 92300 Levallois-Perret and registered with the RCS of Paris under number 830 679 189. We can be reached at hello@better-world.io
We operate the website available at the following URL www.better-world.io (the “Website”) and the online platforms available at URLs on better-world.io domain (the “Platform”).
The publishing director of the Website and of the Platform is Daniel Ritter.
The hosting service provider of the Website is Squarespace which registered office is at Le Pole House, Ship Street Great, Dublin 8, Ireland and phone number is +3531905859.
The hosting service provider of the Platform is Amazon Web Services EMEA SARL which registered office is at 38 avenue John F. Kennedy, L-1855 Luxembourg and phone number is +352 26 73 33 32.
Our contract
This contract (the « Better World User Terms ») is concluded between Better World and any user of the Website and / or of the Platform (“You” or “Your”).
The Better World User Terms govern Your access to and use of (i) the Website and its content, e.g. logos, images or texts (the “Website Content”), (ii) the Platform and (iii) the content accessible on the Platform or any other content provided by Better World other than the Website Content, in any format through any media, including without limitation text, reports, data, statistics, diagrams and charts (the “Service Content”) created pursuant to the Better World Services License Agreement.
When accessing to and using the Website, the Website Content, the Platform and the Project Content, You agree to comply with Better World User Terms.
Language
The Better World User Terms are made in English language. You may request to Better World a French language version of the Better World User Terms at the following email address: hello@better-world.io. In case of conflict between the two versions, the English language version shall have precedence.
Access to the Platform
You may access the Better World Platform if such access has been authorised pursuant to the Better World Services License Agreement between Better World and Your organisation.
You may access the Platform with a username and a password (the “Identifiers”) provided by Better World to Your organization.
The Identifiers are personal to You. You shall keep any Identifier confidential and shall not share it with any third party. Better World shall not be held liable for any unauthorized access to the Platform which is due to the disclosure of Your Identifiers in breach of this clause.
Intellectual property
For the purposes of this clause, “IPRs” means all copyright, moral rights, database rights, trade mark rights, trade secrets, know-how and all related rights and neighbouring rights and any other intellectual property rights of whatsoever nature throughout the world whether or not registered or capable of registration including all renewals and/or extensions thereof.
The Website Content remains the property of Better World. You undertake not to reproduce or use any of such content for any purpose whatsoever.
Better World User Terms do not provide for any transfer or assignment of Better World’s IPRs to You.
Better World hereby grants to You, a worldwide, revocable, non-transferable, non-exclusive license to use the Service Content solely for internal business purposes including research, product development and product improvement. No commercial use (including without limitation marketing and promotional purposes), distribution to any third party, sale or disclosure of any element of the Service Content is authorized by this license.
You are not entitled to grant any sub-license, in whole or in part, of any of the rights granted by Better World under Better World User Terms, without Better World’s prior written consent.
Data Protection
For the purposes of Better World User Terms, “Data Protection Legislation” means the General Data Protection Regulation EU 2016/679 and applicable national personal data protection laws and regulations, including without limitation the French loi n°78-17 relative à l’informatique, aux fichiers et aux libertés, as amended from time to time.
You will comply with applicable Data Protection Legislation when accessing and using the Website, the Platform and the Service Content. Better World will assume no liability or responsibility for any resulting breach of such legislation.
Your personal data, as defined by the Data Protection Legislation, is processed in accordance with the terms of Our Privacy Policy https://www.better-world.io/privacynotice.
Disclaimer of warranty
For the purposes of this clause, “Loss” means any demand, claim, action, proceeding, liability, damage, loss, penalties, fines or interest, cost, expenses and charges, including reasonable legal fees, actually and directly incurred by the relevant party.
Better World does not provide any warranties or representations regarding the accuracy or completeness of the Service Content or that the access to the Website and/or to the Platform will be uninterrupted or error-free. Better World shall not have any liability for any errors or omissions in the Service Content or for any interruption or unavailability of the Website and/or of the Platform, nor for any Loss resulting from the interpretation, use or exploitation of the Project Content or as a result of decisions that are taken on the basis of the Service Content. In addition, Better World shall have no liability to You to the extent such liability arises a result of a breach of the Better World User Terms by You.
Severability
If any provisions of Better World User Terms shall be held illegal or unenforceable by a court of competent jurisdiction then such provisions shall be severed and the remainder of Better World User Terms shall remain in full force and effect.
Change to Better World User Terms
Better World reserves the right to adapt or modify the Better World User Terms at any time. In the event of any modification, You will be asked to accept such new terms when accessing the Platform.
Governing law and jurisdiction
Better World User Terms are governed by French law. The parties submit their disputes to the exclusive jurisdiction of the Paris courts.
